Water/sewer authorization

The government’s review of a proposed development project requires a finding of adequate water and sewer capacity before the project can proceed. Lerch Early land use attorneys have successfully helped clients obtain water/sewer authorization approval.

In areas not currently serviced by public water and sewer, our land use attorneys work with government officials and the WSSC to pursue water and sewer category changes to accommodate a proposed project. In addition, Lerch Early land use attorneys help clients investigate whether capacity exists at a specific location and in areas that are currently deficient, determine what uses can be accommodated on-site without triggering costly upgrades. Where sanitary sewer upgrades cannot be avoided, Lerch Early land use attorneys work closely with City Staff to determine the scope of required upgrades.
