Commercial Lending

The attorneys in Lerch, Early & Brewer’s Commercial Lending practice group represent lenders throughout the greater Washington, D.C., area. We provide knowledgeable lending counsel to national, regional and local banks, credit unions and SBA lenders, including nine of the Washington Business Journal’s “Top 10 Commercial Lenders.” (Washington Business Journal Book of Lists 2010).

Creative Problem Avoidance and Solutions

Our attorneys focus on closing commercial loans through intense attention to detail and creative problem solving. We strive to prevent problems with thoughtful planning, negotiation, documentation, due diligence and review. Our attorneys’ extensive experience, coupled with an exceptional support staff, helps ensure that our clients’ loans are closed correctly and efficiently. When challenges do arise, we find solutions rather than allowing obstacles to delay or derail closing.

When a borrower experiences issues that cause a loan to go into default, we work with our client to develop and implement creative loan workout agreements. If a successful workout agreement or loan modification cannot be achieved, we can initiate a foreclosure action in Maryland, Virginia or the District of Columbia as appropriate, and together with our litigation group, pursue other remedies.

Breadth of Experience

Whether the deal involves a $500,000 small business loan, a complex construction loan of tens of millions of dollars or a creative loan workout, our attorneys provide depth of knowledge and experience to benefit the loan officers with whom we work. In the area of real estate and construction lending, we leverage our experience in commercial real estate lending with our firm’s real estate and land use groups’ skills to address all aspects of the transaction and any issues that could potentially arise.

For asset-based loans, our group has experience in documenting and closing loans secured by such diverse collateral as motor vehicles, securities, equipment, airplanes, boats and railcars. Our group also is one of the preeminent firms in the region providing counsel for government-guaranteed loans, particularly SBA loans.
