Employment attorney Marc Engel recently appeared on the ExitReadiness Podcast, where he discussed the current state of non-compete agreements across the nation.
By way of background, in January 2023, the FTC proposed a broad non-compete ban, and in April 2024, it adopted its final rule. However, a federal court in Texas subsequently enjoined the law from going into effect, stating that the FTC lacked the authority to issue a nationwide ban. As a result, the rule is currently set aside.
Despite this setback, laws banning non-competes and similar agreements are becoming increasingly prevalent across the country. Marc also recently discussed the matter at Lerch Early’s Employment Law Day.
