Stuart R. Barr

Stuart Barr is a land use and zoning attorney at Lerch, Early & Brewer.  His law practice encompasses the areas of land use, planning, zoning and rezoning, real estate development and redevelopment, master plans and sector plans, due diligence, building, use and occupancy, and other permits, water and sewer category changes, condemnation and eminent domain, administrative law, annexation, and historic preservation.

Stuart represents a wide range of clients before the Montgomery County Planning Board and planning staff; the Board of Appeals; the Montgomery County Council; the Montgomery County Departments of Permitting Services, Environmental Protection and Transportation; the Historic Preservation Commission; and before other agency departments and commissions throughout Montgomery County. Stuart also appears regularly before the planning commissions, boards of appeals, mayors and councils, departments and agencies in the City of Rockville and the City of Gaithersburg.  
 
He specializes in real estate development approvals including subdivision (preliminary plan), resubdivision, minor subdivisions, site plan and site plan amendments, project plans, special exceptions (conditional uses) and special exception modifications, variances, administrative appeals, nonconforming uses, zoning text amendments, local map amendments (rezonings), signage approvals, easements and covenants, Transferable Development Rights (TDRs), Historic Area Work Permits, annexation, and building permits in Montgomery County, the City of Rockville, and the City of Gaithersburg.
 
His extensive experience includes assisting the firm’s retail and development clients with new locations and working with the firm’s institutional clients on expansions with a particular focus on special exception approvals for life care facilities, nursing homes, gas stations, country clubs, community swimming pools, and private schools. He also represents property owners whose property has been condemned under eminent domain in order to achieve just compensation for their property. Stuart’s clients appreciate his commitment to finding creative solutions to difficult problems, as demonstrated in both his level of detail and his consideration of many options for each challenge.
 
Born in Atlanta, Ga., Stuart grew up in Bethesda. He received his Bachelor of Arts from Lawrence University in Appleton, Wis., and returned to this area to earn his Juris Doctor, with honors, from the University of Maryland School of Law. While in law school, he earned a concentration in environmental law.
 
Prior to joining Lerch Early in 2001, Stuart served as a judicial clerk to The Honorable Albert J. Matricciani, Jr., of the Baltimore City Circuit Court (now on the Maryland Court of Special Appeals), and as a scholar attorney in the Montgomery County Attorney's Office.
 
Stuart is a member of the Maryland and Montgomery County Bar Associations, and is admitted to practice in Maryland, the District of Columbia, Virginia, and the U.S. District Court for Maryland.  He is active with the Gaithersburg-Germantown Chamber of Commerce, where he sits on the board of directors, the Montgomery County Chamber of Commerce and the Maryland National Capital Building Industry Association (MNCBIA).
 
In the community, Stuart has recently volunteered his legal services to help Habitat for Humanity of Montgomery County on a significant townhouse development in Gaithersburg. He also serves on the board of The Corridor Cities Transitway Coalition and participates on the County’s Sustainability Working Group.  He previously served for four years as chair of the Planning and Housing Subcommittee of the Wheaton Redevelopment Advisory Committee.
 
A resident of Gaithersburg, Stuart enjoys spending time with his wife and two daughters, traveling, and playing in the Montgomery County Bar Association softball league.
