Marc Engel brings more than 23 years of wide ranging civil litigation and counseling experience to his clients. Mr. Engel, who co-chairs the firm’s Employment and Labor Group and is also a partner in the Litigation Group, has represented clients of all sizes in state and federal court litigation and before various arbitration panels. His practice primarily focuses on advising clients on a variety of employment issues and litigation avoidance strategies; and litigating and mediating employment and business matters. Mr. Engel is a frequent speaker on employment matters and litigation avoidance practices. He has been selected by the Circuit Court for Montgomery County to be on its approved list of mediators for civil matters. He has received Martindale Hubbell’s highest peer review rating (AV) for lawyers and, in 2006, was selected as a member of the “Greater Washington Legal Elite” by SmartCEO Magazine for his work on employment matters. Mr. Engel received his law degree from Columbia Law School (1985, member, Human Rights Law Review) and a B.A. from the University of Maryland (1982, Phi Beta Kappa, magna cum laude). He is admitted to the Maryland and District of Columbia bars.
Mr. Engel has managed all aspects of business litigation including all pre-trial and trial work, appeals, and settlements. He also has worked closely with in-house counsel, business executives and managers to develop successful litigation avoidance strategies. As a counselor, Mr. Engel advises clients regularly on employment issues. His experience includes:
- Counseling clients on how to comply with state and federal employment statutes, including the American With Disabilities Act, Family and Medical Leave Act and federal and state wage hour laws
- Drafting handbooks, employment agreements, severance agreements, independent contractor agreements, and telecommuting agreements
- Conducting anti-harassment training for employees and managers on a group and individual basis
- Conducting in-house seminars for clients on successful strategies for improving hiring decisions, dealing with problem employees and increasing employee retention
- Advising clients on cost effective alternative dispute processes and drafting creative arbitration provisions
- Successfully negotiating and mediating numerous litigation and employment disputes
- Defending employee discrimination charges in administrative and judicial proceedings
- Reviewing agreements and employment documents for potential litigation problems
- Performing employment audits for clients
- Speaking to numerous business and professional groups on various employment and litigation topics
- One-on-one counseling of professionals on harassment and discrimination matters, and the risks associated with unprofessional behavior
As an advocate, Mr. Engel has guided clients to the successful resolution of dozens of matters. Mr. Engel also serves as a mediator for private and court-appointed employment and litigation matters. He also has served as the designated mediator in conjunction with a corporate ADR program.
