In August, the National Labor Relations Board (NLRB) issued a Final Rule that would have required most private employers, as of November 14, 2011, to post a notice informing employees of their rights under the National Labor Relations Act, in particular, their rights to join labor unions. The NLRB later postponed the implementation date to January 31, 2012. Apparently under pressure from the federal District Court for the District of Columbia which is hearing one of the legal challenges to the posting requirement, the Board has again delayed the date for implementation of its Rule, until April 30, 2012. The NLRB may be engaging in wishful thinking when it writes in the second paragraph of the release that: "[m]ost private sector employers will be required to post the 11-by-17-inch notice on the new implementation date of April 30."
There is a distinct possibility that the notice requirement will be rejected by the courts, and in any event, if the challenges are still pending as April 30 approaches, a further postponement is likely
