Jeremy Tucker and Mike Goecke spoke about the legal and practical issues involved with addressing cigarette smoking-related complaints within condominiums at the Community Associations Institute Washington Metro Chapter’s 2011 Conference & Expo. They reviewed the types of rules and amendments that associations can adopt, and discussed the potential consequences for boards that fail to take action addressing smoking complaints. Their session included a brief review of case law from around the country where residents have filed suit against their condominiums for failing to take preventative action against cigarette smoking.
