April 2010 -- Harry C. Storm will be speaking at the American Bar Association Petroleum Marketing Attorneys’ Meeting about the first Petroleum Marketing Practices Act case heard before the U.S. Supreme Court. In March, the U.S. Supreme Court issued its decision in Mac’s Shell Service v. Shell Oil Products. This case, the first PMPA case heard by the Court, will necessarily alter the legal landscape under the Act because it resolved existing conflicts among the Circuits and will provide guidance on whether and to what extent claims of “constructive terminations” will be viable under the Act.
